Terms of Sale and Subscription

1. Subject Matter

These Terms govern the purchase and use of the paid services (Pro subscription) offered by the Drusilla platform, a proprietary project of:

2. Type of Service

Drusilla provides a digital information and decision-support service based on software and artificial intelligence technologies.

The Pro service:

  • extends the features available compared with the free version;
  • allows more extensive use of resources and services;
  • does not alter the informational and unofficial nature of the service.

3. Free Version and Service Trial

The user has the possibility to test the service free of charge, without time limits and without any obligation to purchase, before subscribing to the Pro subscription.

The purchase of the Pro service therefore takes place in a conscious and informed manner.

4. Pro Subscription

The Pro subscription:

  • is a paid service;
  • provides access to advanced features;
  • is linked to a single personal account.

The available features may include, by way of example:

  • greater availability of resources;
  • access to advanced services;
  • extended use of AI support.

5. Prices and Payments

Prices:

  • are clearly indicated at the time of purchase;
  • are inclusive of applicable taxes, unless otherwise indicated.

Payment is made through the methods indicated at the time of subscription.

Purchases via mobile app. If you subscribe to the Pro subscription from the iOS or Android application, the purchase is handled as an in-app purchase through Apple App Store or Google Play. In that case the payment is charged to the user's Apple or Google account and the terms and conditions of those platforms also apply. ZERO5 S.R.L. does not process or store payment card data.

6. Commencement of the Service

The Pro service is activated immediately upon completion of payment.

From the moment of activation:

  • the user may access without limitation the features provided by the Pro plan;
  • the service is considered provided.

7. Renewal and Cancellation

The Pro subscription may provide for:

  • automatic renewal, where indicated;
  • the possibility of deactivation by the user according to the specified procedures (from the web platform or, for in-app purchases, from the Apple or Google account settings).

Deactivation prevents subsequent renewals, but does not entail a refund for the period already paid.

For subscriptions taken out via the mobile app, cancellation and management of automatic renewal are carried out directly in the account settings of Apple (App Store) or Google (Google Play), in accordance with the procedures provided by those platforms.

8. Exclusion of the Right of Withdrawal

Pursuant to Art. 59 of the Italian Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content or digital services when:

  • performance has begun with the user's express consent;
  • the user has had the possibility to test the service free of charge and without time limits;
  • the service is provided immediately after purchase.

By purchasing the Pro subscription, the user:

  • requests the immediate activation of the service;
  • expressly accepts the exclusion of the right of withdrawal;
  • waives any request for a refund for purchases made directly on the platform.

Purchases via store. For purchases made through the Apple App Store or Google Play, the refund policies of Apple and Google remain unaffected; the user may request refunds directly from the store in accordance with the respective procedures.

9. Limitations of Liability

Drusilla provides an informational support service.

ZERO5 S.R.L. does not guarantee:

  • specific results;
  • absolute continuity of the service;
  • absence of errors or inaccuracies;
  • completeness, accuracy or currency of the data provided.

In no event may ZERO5 S.R.L. be held liable for:

  • improper use of the service;
  • decisions made by the user on the basis of the information provided;
  • configurations applied to the instruments;
  • direct or indirect damages arising from reliance on the information provided by the service.

Territorial data and restrictions

With specific reference to the services for consulting territorial data, landscape restrictions and cultural heritage assets:

  • the information provided is purely indicative and informational in nature;
  • the data are processed from public sources and may not be up to date, complete or accurate;
  • the service in no way replaces consultation of the competent bodies and authorities;
  • the user is required to independently verify all information before making any decision;
  • ZERO5 S.R.L. declines all liability for direct or indirect damages arising from the use of or reliance on such information;
  • the user is required to know and comply with the applicable legislation on the matter.

10. Proper Use of the Service

The Pro subscription:

  • is personal;
  • may not be shared.

Only one active session per account is permitted.

Improper use or use contrary to these Terms may result in the suspension or termination of the service, without any right to refunds.

11. Changes to the Service

ZERO5 S.R.L. reserves the right to:

  • modify the features and contents of the service;
  • update the subscription plans.

Changes do not affect the rights already accrued by the user for the paid period.

12. Applicable Law and Jurisdiction

These Terms are governed by Italian law.

Any dispute shall be subject to the exclusive jurisdiction of the Court of Cosenza.

13. Acceptance

The purchase of the Pro subscription implies full acceptance of these Terms of Sale.
